Assignment details:
The Essay Assessment requires students to demonstrate their knowledge of the
Australian business law, concepts, and rules. To successfully answer the questions, the
analysis, the discussions, and examinations of topics must be supported by the relevant
sections of the law, cases, examples, journal articles and books. For this Assessment,
students must answer four questions. You are expected to write about 500 words for
each question, and total of 2000 words for Assessment 3.
Essay Questions
1. By giving at least four different examples, explain the different business
structures. To completely answer this question, you must define each business
structure, explain the legal requirements to establish each business structure
and explain the differences between each business structures.

2. Examine the legal protections provided under the Australian Consumer Law
for consumers. To completely answer this question, you are required to

support your discussion with the relevant sections of the law and provide
elevant court cases that show the legal protections provided under Australian
Consumer Law.

3. Identify the essential elements that should be fulfilled to have a valid contract,
and by giving relevant examples, elaborate the available remedies if there is
each of a contract. To completely answer this question, you need to support
your answer with the relevant sections of the law and relevant examples.


4. Discuss the different aspects of legal risks of doing business. You can answer
this question from the perspective of negligence, tort, business crimes and
usiness ethics.
You will make a presentation on the main points of your answers for the Essay questions. The
presentation must show the main findings and you have 10 minutes to complete the presentation, and
5 minutes to answer questions.

In Australian context, there are four types of business that can be operated legally. The first type is sole trading, in which individual operations of business is accepted. Sole trade is the form of business where one person can register his or her company under sole proprietorship. Mostly, the name adopted for this kind of business is with the name of the person such as John Greens Grocery, Mary’s Departmental Store and Smith Wine Shop. Besides, it can be registered by following the company law in Australia. This type of business usually does not require any contract to exist. Sole trading requires operating the business through the calculation of the taxable income and margins of profits earned in single financial year. In other words, sole trading is categorised as taxable by Australian business law (Bant & Peterson, 2019).
The second type of business is based on the partnership of two or more persons. This is slightly complicated form of business than sole trading because it not only requires registration under the Australian business law, but also it needs to have a valid contract between the parties willing to operate the business jointly. This is more like having the rule book of operations; this rule book is legally perceived as the mutually accepted offers made against the favours to each other. The registration process is liable to bear the expanses of the Australian government as well as paying of the taxes. The taxable income of the partnership based business is done by filing the income tax returns at the end of the financial year. Partnership business mode requires to have tax filing number as well (Bant & Peterson, 2019).
The third type of business in Australia is to structure a company (Pty Ltd). There are two modes of companies that are legally acceptable; the public company and the private company. Public companies have shared administration process, which is listed in Australian Stock Exchange. There are shareholders who share certain amount of partnership in business. The board of directors is appointed by mutual acceptance to run the business. The advantages of public companies include having limited liabilities towards the assets of the company only. The fourth and the most sustainable type of business in Australia is Trust (discretionary or unit based). By law, there are transfe
able rights of business to the third party in this business type and this third party ca
ies out the role of administrator. The entire financial management remains in the hands of third party. The shared state of governance makes this business to be the stabilised one in the general context. To register a trust, Australian business law norms expect to have valid contract, tax file number as well as evidences of competency of the third party to run the business appropriately. Trusts are made by having discretionary or unit based rights as well.
