You are required to complete the following assessment:
Question 1:
What do you understand by the doctrine of ‘separation of powers’? Discuss how ‘separation of powers’
has been adopted in the Australian constitution. Critically analyse the importance of separation of
powers. (6 Marks)
Question 2:
Describe how the Australian Constitution has divided legislative powers between the Federal Parliament
and State parliaments in Australia. In your answer, give at least one example for each of the 3 types of
power. What happens if a State makes a law that conflicts with a law made by the Federal parliament? (6
marks)
Question 3:
What is legally required to start up a sole trading business in Australia? In comparison to a company,
discuss the advantages and disadvantages, if any, of doing business as a sole trader. (8 marks)
