In the concern of an organization, franchise is much importance because it describes a
legal a
angement that have signed by two parties. Through this agreement, one party gives a
license to another party with an intention through that other party could sell the existing product
and related services of first party to their customers. The format franchise is generally as similar
as like the format of business organizations.
It is because that the franchisor provides the complete information to the franchisee about
the business model and how the franchisee will operate it to make money (McDonald's
Corporation, 2001).After forming contract, franchisor also imposes some rules and regulation
over the franchisee for controlling their activities to retain the image, reputation and wealth of
the parent business entity in target market. Hence, in this context, this paper would describe the
usiness related rights of franchisee against McDonalds as a franchisor. This paper also depicts
those challenges which a franchisee could face by the rules and regulation of McDonalds.
Legal rights of Franchisee
After signing a contract, franchiser transfers a collection of rights related to intellectual
property. This set of rights generally includes McDonald’s trademark, patent rights and
egistered designs that help the management people of my franchisee for attracting customers for
growing the business effectively (McDonald's, 2013).The contract document generally includes
the terms and condition to start and perform the business activities fruitfully.
Hence, as a business entity of McDonald, it is my legal rights to ask for entire
information related products, trademarks, copyrights, patents, secrets related to products and
manufacturing process and clauses that are added by McDonalds in associated documents. These

terms are also valuable for me because these would help me to attract the customers as a part of
McDonalds.
It is because that as like McDonalds, my franchisee has also a right to provide the similar
products to my customers as like as the McDonald’s products. The right related to patents,
copyrights, and trade secrets are generally favored the franchisor. Therefore, as a franchisee, it is
also my rights to call McDonald’s HR department to provide the training to employee to manage
and maintain profitability of organization effectively (Moore, Palich& Petty, 2006).
Instead of predefined terms and conditions, there are some regulatory requirements that
are necessary for the franchisor to apply with the distribution of franchise. The distribution of
profits, expansion of market, selection of te
itory and the setting of products price are some
ights that a franchisee could use. Under the act of 1988, it is my rights to put my evidence for
holding my franchisee because of huge financial investment (Moore, Palich& Petty, 2006).
Simultaneously, it is my right to collect the information and evidence related each year
along with products’ demand in each financial quadrant. As a legal business entity, it is also my
ight to sue a case against the McDonalds to get my involved money, if McDonald does not
fulfill its requirements legally.
Financial Obligation of Franchisee
For providing transfe
ing the rights to franchisee to perform business activities, the
managing people of McDonalds employs many financial obligation for securing and protecting
their wealth, and retain their control over existing business concepts (McDonald's., 2013).In
general, McDonalds makes a force on franchisee for making a costly outlet that requires huge
finance from franchisee and McDonald does not provide any financial help to setup the outlets.
After this, McDonalds also charges the franchisee high fees (Entrepreneur Media, Inc., 2013).It

McDonald’s guideline.
Hence, it could be also defined that McDonalds also employs major financial obligation
of franchisees towards the franchisor. For opining a franchised unit requires startup cost that
generally includes several fees on its franchisees to pay after a regular interval for holding the
franchise of McDonalds.
