Use of Plea Bargains. What might happen to the criminal courts if plea bargaining were eliminated? Does the concept of a plea bargain encourage innocent people to plead guilty to lesser charges in order to avoid the risk of a trial and being sentenced to more severe punishment? Why are indigent defendants more likely to enter into plea bargains? What type of discrimination might this add to the system? How do these serve as important bargaining chips for prosecutors? Or defense attorneys? Do you think that Chris Farias, after his third DUI, should have been allowed to plea bargain? What about Danny Madrid—should a plea bargain be made available to crimes such as attempted murder?
