Intro to Law LPSC 1101 – Section 02 Quiz 1 NAME: Please answer the following in a word processor, save it as “[LAST NAME] QUIZ 1” and submit to TurnItIn on Blackboard by Monday, February 4, at 2:50 P.M. There is no need for long answers. In fact, short, to-the-point answers will often be much better than the ‘throw everything against the wall’ approach, but there are no word limitations. Do not put your answers in bold. Hart and Michaels are professional wrestlers for the Company. That is, they are actors paid to pretend they are wrestling. They work for Vince who owns the Company. Hart held the Championship Title. One night, Michaels challenged Hart for the Championship Title. Going into the match, Hart thought he was going to win. However, under Vince’s orders, Rebecca Referee awarded the Championship Title to Michaels at the end of the match. Hart was furious because normally you know beforehand when you are going to lose the Championship Title. After the match, in the backstage area, Hart walked hurriedly down the hallway, knocking Rebecca Referee to the ground, who was walking in the same direction but slower. He kicked open the door to Vince’s office. Unbeknownst to Hart, Vince was standing by the door. Vince saw the door and screamed “OH NO!” and the door wacked him in the head and he fell to the ground. Hart ran in and said “Serves you right!” Then Hart ran around backstage trying to find Michaels, and eventually did. As Michaels was turning to face Hart, Hart stabbed him with a chef’s knife. Subsequently, Hart was charged by the State of New York with assault and battery upon Rebecca Referee, Vince, and Michaels. However, the court dismissed the charges, holding that there was not enough evidence for a jury to reasonably find Hart guilty. 1.) What burden did the prosecution not meet? (5 pts.) Introduction to law
1. The prosecution did not meet the burden of finding evidence and being able to judge the case
ased on the arguments provided by each of the parties. The trial was right as far as the charges
were presented. But after that it became essential to provide witnesses and prove these charges in
order to punish the accused. Since this did not happen, it became difficult for the trial to proceed
and though the case was not dismissed, the charges were dismissed. In this way the prosecution
were not able to present evidence.
2. As a lawyer, I would tell him that he has committed the tort of assault and though his position
was strong in the criminal court, it might not be strong in a civil court. He would require to
present his arguments to the judge as his outburst was mainly due to unfairness to him in
employment. Moreover he had not intended to hurt any one. He was angry but did not
intentionally hurt Rebecca or Vince. Moreover if he sta
ed Michaels only when he came to
charge him and so it was self defense, only then though the situation did lead to assault none of it
was intentional. Only then he can be not guilty.
3. The very first step of my legal reasoning regarding the lawsuits against Hart is that when
Michaels was not even talking to Hart and was involved in a professional argument with Vince.
So Hart had no reason to charge Michaels. He can be sued for assault. The second step is to tell
Hart to accept his charges since they are unreasonable and he sta
ed Michaels as a result of
having lost his temper.
4. The second definition is more relevant since it focuses on fear of imminent physical harm.
Moreover since in this case Michaels sta
ed Hart only because of fear of being charged, and not
ecause of physical imminent charge. In reality fear as well as actual imminent physical harm are
considered as assault. In this case the one based on the state legislature and signed into law by...
