Introduction
Intellectual property (IP) is legal recognition of intangible assets such as ideas, inventions, discoveries, artistic works, phrases, symbols and even designs. In this case, the law protects valuable products that have been generated out of a person’s mental creation. Infringing of intellectual property rights can be punishable under the law. Apple recently sued Samsung for infringement of its copyrights in the design of the Smartphone technology. The case was taken to court and the jury ruled that Samsung should pay 1.05 billion dollars to Apple for the violation of Intellectual Property rights.
Case Compliance with the Law
Patent Infringement
The case complied with the law because patent infringement is prohibited. According to business law, a party that manufactures, sells, or imports patent technology without a license or permit is considered an infringement. This means that Samsung infringement of the copyright of Apple designs without their permission is illegal. The idea of patent infringement is based on using an invention of another party without proper permission.
