Equity in Punishment Part II. How should the criminal justice system, specifically the courts, address issues of victim characteristics in the system? In Jennifer Schuett’s case, a minor was brutally assaulted by an adult. Should a judge or jury be able to rule more harshly when the victim is a minor versus an adult? Should a judge or jury be able to hand out a stiffer penalty when the victim is a stranger to the offender? What if the victim is mentally incapacitated? Or physically disabled? Should characteristics of the victim play a role in the way courts handle these cases? Is your decision based on the Constitution? If not, on what basis do you make your decision?
