A contract to which I am a party is the employment contract. It is a contract between me
and my employer. It provides several terms and conditions that explain our employment relation
and the terms and conditions that bind it. The terms and conditions that bind it include the
covenants of not working with a competing firm, not giving out trade secrets and also about
termination notice. It also includes compensation and job role.
The terms of employment are the main elements that form the contract. It explains the
ules which bind and legalize the employment. Yes, it does have all of the elements of an
enforceable contract since there is agreement in the form of signatures, consideration in the form
of compensation to be paid to the employee for work rendered, legality in the form of it being a
contract and capacity since the parties are entitled to enter into this agreement.
One item that surprised me was the pay scale increase mechanism. The reason why it
surprised me was that I presumed it would increase based on my performance and not based on a
contract. Yet it is a common element present in all employment contracts.
One item that seemed unfair was the competent clause. As I am not employed for a
unique service or do not have unique skills, I felt that the clause that restricted me from working
with any other competing firm after termination for a period of 18 months felt unfair to me.
