Every person has to consider different rules and regulations. While analyzing the law of torts we 
can understand that duty of care plays an important role. It is duty of the companies to protect the 
customer’s needs and their health. Customers also have the responsibility to take care of their 
health and interests. As per the report of Australian Consumer Law (2013), tort of negligence 
helps for protecting the personal as well as economic interest of the individuals. While analyzing 
the case of Tamara we can understand “Duty of Care “and “Tort of Negligence” plays an 
important role. Now we can focus on the major issues and facts related with the case.

1. Whether there is negligence on the part of Aldi supermarket? 
Issues 
While analyzing the case we can understand that Aldi supermarket gives more importance to 
customer interest and health.  Aldi supermarket tried for provides better services to the 
customers. The major issue related with the case is that Tamara slips on a puddle of melted ice 
cream and breaks her back.  
Rule 
While analyzing the case we can understand that the major rule related with the case is tort of 
negligence. Tort of Negligence says that “negligence’ means failure to exercise reasonable care
