Purpose of Federal Small Business Program
Congress from its time of existence has been a
oad authority which has from time to
time imposed requirements on the federal procurement process or the process which is
asically related to the agencies obtaining goods and services from the private sector. One of
the landmark measures being taken from the Congress whereby it has exercised its authority
is the promotion of the contracting as well as the sub contracting of ―small business‖ by
federal agencies FAR (n.d.). . The general measures of this program constitutes to: -
 Declaration of the policy pertaining to the congressional measure which ensures that
there be a ―fair proportion‖ of the federal contract and subcontract which assigns the
dollars as a means for awarding it to the small businesses;
 Establishment of the government wide as well as the agency specific goals pertaining
to the percentage of contract and or subcontracting with the intent of awarding dollars
to the small businesses;
 Requirement of authorizing the agency to conducting the competitive environment
whereby only small businesses can hover in the market or by initiating the non
competitive awarding system to them when such awards could not be established for
the businesses FAR (n.d.).;
 Tasking of the SBA i.e. Small Business Administration and also the officers of the
procurement agencies with the intent of reviewing as well as helping the restructure of
the given proposed procurements which are being laid so as to maximize the maxim
opportunities for the participation of the small business
There have been historical events pertaining to the same whereby the small business
administration got its essence of the business intent in the market and to enjoy the trade more
freely and appropriately. One fine example of the same is pertaining to the case of Perkins v.
Lukens Steel Co., 310 U.S. 113, 127 (1940), whereby it was seen that the government in its
case has the unrestricted power which is parallel to the private limited companies where the
government has its own rights to determine with whom it will make contracts, and to even fix
the norms regarding the contract as per his own will FAS ORG (n.d.).
Upon this, the US Constitution ensured that the Congress be given limited powers so
as to safeguard the interest of the citizens as maintaining the equal protection is equally
important according to the law. Same was in the case of Boiling v. Sharpe, 347 U.S. 497
(1954) where the equal protection norm was important so as to apply the law equally to all
citizens and not being bias over a section of people GSA GOV (n.d.).
It was also seen that the Race and Gender be suspect classifications i.e. it should be
demonstrated by the authority that the decisions are being tailored to further compelling
government interest, in the case where it is found that race conscious programs or gender
specific programs are run where the government objectives are held to be supreme, apart
from other things.
Hence, it was held that the small businesses should be favored by initiating them to
make the competitive environment in the market place and that they be favored over the large
usiness houses. As the small businesses make things happen by creating a strong
community, the small businesses would be run on the principle of equal protection of the
Federal Agency.
Small Business Set Aside Program
There is an interim rule amending the FAR subpart 8.4 which makes it further clear
that the set asides for the small businesses may be utilized in the connection with the intent of
placement of orders as well as the establishment of the BPA’s pertaining to the scheduled
