Introduction to the English legal system
The English legal system is one of the oldest legal systems. It contains of laws and
ylaws which help form the framework for not only day to day contracts and business but also
the basis for defining the acceptable and legal aspects. The English legal system is the
foundation for the common law and its essence is a court where in judges apply their common
sense for a ruling and their knowledge about legal precedent. Case laws and legislations form
an essential element of this legal system.
Statutory and common law provisions
Some of the most important statutory and common law provisions include criminal law,
constitutional law, administrative law, family law, tort, contract law, property law, trust law,
labor law, evidence and miscellaneous. These statutory and common laws creates an impactful
framework for the purpose of governance and legal administration of justice. It is quite a popular
legal system and it has been adopted by many countries after modifying it as per their
equirements (Beale, Joseph H, 1935).
Statutory and common law provisions applicable to Sam's case - Part 1
In Sam's case where in he has been convicted of an offence of parking his mobile van in a
estricted premise, it can be considered as a tort where trespassing and conducting a mobile
food business in a premise where it is restricted is illegal. The law of trespass includes
trespass of goods which was established in case laws formed in Kirk v Gregory and Slater v.
Swann. In these cases it has been established that it is not legal to move even a good into a
estricted area. Moreover conducting a business in any prohibited area is thus not allowed
(Barnett, Hilaire, 2008).

In this case, as Sam has been convicted of the offence, it is possible that he be stopped
from any further conducting of business in the premise. He could be fined and even
imprisoned for the same. It is crucial for conducting a business, including a mobile food
usiness, of any nature to be conducted appropriately with permissions on the premise where it is
allowed and not be conducted in areas where it is restricted (Slapper, Gary; David Kelly, 2008).
