Elmer Johnson is a design engineer with a proven track record in the field of electronic musical instruments. He recently designed a new very large-scale integration (VLSI) chip. This chip is meant to be the heart and soul of a digital sampling keyboard to be named Echo. Johnson believes that Echo will set a new industry standard. • Johnson is aware that he is not qualified enough to manage the new enterprise. However, he wants to have the authority on how to proceed with the development and marketing strategy.
• Five more investors would invest in this project if they get guaranteed fixed returns on their money or realize immediate tax benefits from the investment.
• Johnson would like Barney Fife, a manager much in demand in the electronics field, to act as the chief operating officer (COO) for his enterprise. However, Fife would be interested only if the offer is highly profitable for him.

In the given case, Mendoza v. Borden, Inc. (1999) it is important to determine whether Red
Mendoza, the appellant has given enough evidence to proof his viewpoint or not. Mendoza
use to work for Borden and claimed that she was being sexually harassed by Page who was
the highest ranking officer of the company in that facility in Miami (caselaw.findlaw.com,
2013). She sued the company under Age Discrimination in Employment Act, Americans with
Disabilities Act and sexual harassment.
According to Title VII of sexual harassment law a hostile environment claim must fulfil some
criteria’s such as participation of the employee in a protective group; must prove that he/she
has been sexually harassed, a claim or reason to proof employer involvement.
Further, in the given case, no proof has been given to show that Mendoza was physically
threatened, humiliated, frequency of the conduct or being interfered in his job performance.
Beside this, the four conducts given by Mendoza, none of them are severe or pervasive (West
Publishing Company, Lawyers Co-operative Publishing Company, 2001). Further, none of
the actions as described by Mendoza against page shows any alternation in the terms of
payment (Davies, 2011).
