Tort claims are the claims which are done for the damage or loss of death or personal injury 
or property. It happens because of the negligence or wrongful act within the scope of their 
employment.  
Crime is different from a Tort. Crime is considered to be a wrongful act which is stated as 
a crime by the state or the federal government. In a criminal case, the accused person is 
called as a defendant. Victim is the person who has been injured or hurt. The fine is paid to 
the government then and restitution can be done to the victim. The defendant has to give a 
sentence if he loses. In Crime, punishments include fines which are paid to the government, 
prison or incarceration in jail. Crimes are mainly defined by the statute. 
A tort is a civil court proceeding. The accused is called defendant but victim is called 
plaintiff. The defendant has to give all the damages to the victim called plaintiff if defendant 
loses.
