Part A: Identify the scope of legal and ethical compliance requirements For part A of this assessment, you are required to research and analyse the scope of legal and ethical compliance requirements that are relevant to a team leader's role in a community sector organisation and write a report on your findings.

Your report must be at least 500 words, and address the following:

  • a)Information sources: Identify a range of current and authoritative information you could access that outlines the legal and ethical compliance requirements for the industry in which the organisation operates. Describe how each requirement relates to team leaders (i.e. how the requirements affect their role/s).
  • NOTE: As a guide, you may like to refer to the suggested resources below:

    • Relevant government websites
    • State and Commonwealth law websites
    • Relevant peak bodies
    • Relevant industry standards
    • Relevant registering bodies
    • State/Territory Worksafe authorities
    • Codes of Practice
    • Industry Codes of Conduct.
  • b)Legal and ethical compliance requirements: Research and detail the specific documents that are used to interpret the legal and ethical compliance requirements that relate to this industry/organisation. In your answer include the following:
    • Websites that the organisation accesses regarding legal and ethical compliance
    • Books, articles and publications that are consulted
    • Internal policies and procedures
    • Organisations/agencies/departments that provide resources, information and guidance
    • Any other information sources that are useful and relevant.
  • c)Stakeholders: Detail the relevant stakeholders that are consulted as part of researching and recording legal and ethical compliance requirements. In your answer include the following:
    • Who the stakeholders are
    • Why they are consulted
    • Issues that they raise
    • The process used to respond to these issues
    • How the information is shared with all levels of employees within the organisation.
  • d)Risks and consequences: Explain how the organisation identifies any risks and consequences of non-compliance (including security of client information) and when the organisation might need to seek specialist legal advice.
  • e)Impacts on operations: Identify two (2) legal and two (2) ethical compliance requirements based on the relevant industry standards that have an impact on the operations of the organisation.
  • g) Regulatory authority: Identify the relevant regulatory authority and describe the functions of the authority and how it impacts the organisation.
  • Part B: Develop two (2) policies and related procedures For part B of this assessment, you will need to develop two (2) short policies and related procedures based on one (1) of the legal and ethical compliance requirements that you identified in part A.

At least one (1) policy and related procedures must relate to a legal compliance requirement and at least one (1) must relate to an ethical compliance requirement for a community sector organisation.

The policies and procedures should be written in a clear and easy to read format.

Each policy and related procedure must include:

  • a) Purpose: Briefly explain the purpose of the policy.
  • b)Scope: Identify who the policy relates to in the workplace.
  • c) Definitions (optional): Explain definitions that not all people reading the policy will understand, e.g. you may define ‘Code of Practice’ as ‘Best practice guidelines issued by Work Safe Victoria on areas such as manual handling, hazardous substances, plant and equipment’. If there is no need for definitions, you may leave this part out of the policy.
  • d) Legislative or ethical context: List the relevant legislation that underpins this policy and procedure, e.g. Occupational Health & Safety Act (Vic) 2004.
  • e) Principle: Explain how the organisation will be responsible for ensuring the policy and procedures are implemented.
  • f) Policy: Summary of what is meant to happen in the policy.
  • g) Procedure/s: Detail the relevant procedural steps relating to the policy and who is involved in each. As this is a short policy, there is no need to have more than five (5) steps as part of the procedure.
  • h) Responsibility: Detail who the policy owner is, e.g. CEO, Operations Manager.
  • i) Distribution: Detail who the policy and procedures will be distributed to and how they will be distributed.
  • j) Version Control: Include a version control section in your policy.
