A person who is a multiple offender according to the law tends to get longer imprisonment on the next offence after the first offence.  The reason that there is a difference in the treatment between the first offender and the multiple offender is the simple assumption that equates crime to a disease. This means that the person has a tendency to commit crime and they should be put in isolation so they are able to cause less harm. This was a popular thought process in the early 20th century where the prisoners on their second and third offence were jailed for longer sentences and some indefinitely.
The law was passed due to the idea that it would reduce violent crime (Hollifield, Warner, Krakow & Westermeyer, 2018). An example of this is the law passing in California in 1994 where a third offence being committed would cause a life sentence. The Judge tends to be more liberal with a person who has just committed a minor crime. The lenient penalties are guaranteed in case of no violence, no major harm and no criminal past.
The courts can sometimes also make first offenders have serious penalties in order to ensure that they never repeat the action again and ensure that an example is made of. The first time offender should be treated with more leniency,
