Apple's chief executive Tim Cook says the company will contest a court order to help the FBI
eak into a phone recovered from one of the
San Bernardino shooters.
The company was ordered to provide "reasonable technical
assistance" to investigators seeking to unlock the data on an
iPhone 5C that had been owned by Syed Rizwan Farook.
"The United States Government has demanded that Apple take an
unprecedented step which threatens the security of ou
customers," Mr Cook said in a statement.
"We oppose this order, which has implications far beyond the legal
case at hand."
The technical assistance ordered included disabling the phone's
auto-erase function, which activates after 10 consecutive
unsuccessful passcode attempts, and assisting investigators to submit passcode guesses electronically.
Federal prosecutors in Los Angeles requested the court order to compel Apple to assist the investigation into the December 2 shooting
ampage by Farook and his wife that killed 14 people and injured 22 others.
The two were killed in a shootout with police.
The FBI has been investigating the couple's potential communications with the Islamic State and other militant groups and treating the
case as an incident of domestic te
orism.
"Apple has the exclusive technical means which would assist the government in completing its search, but has declined to provide that
assistance voluntarily," prosecutors said.
Tech companies increased encryption over privacy concerns
US Government officials have warned that the expanded use of strong encryption is hindering national security and criminal investigations.
Technology experts and privacy advocates counter that forcing US companies to weaken their encryption would make private data
vulnerable to hackers, undermine the security of the Internet and give a competitive advantage to companies in other countries.
In a similar case last year, Apple told a federal judge in New York that it was "impossible" for the company to unlock its devices that run an
operating system of iOS 8 or higher.
The phone belonging to the Farook ran on iOS 9, according to prosecutors.
Prosecutors said Apple could still help investigators by disabling "non-encrypted ba
iers that Apple has coded into its operating system".
Apple and Google both adopted strong default encryption in late 2014, amid growing digital privacy concerns spu
ed in part by the leaks
from former National Security Agency contractor Edward Snowden.
Forensics expert Jonathan Zdziarski said Apple might have to write custom code to comply with the order, presenting a novel question to
the court about whether the Government could order a private company to hack its own device.

efusal to fulIll a judge’s request to help the FBI unlock a suspect’s iPhone in the high-
proIle San Bernardino attacks. Apple’s General Counsel Bruce Sewell, likely alongside
other Apple employees, will deliver the prepared statement below at the hearing titled
Balancing Americans’ Security and Privacy before addressing the panel and answering
questions from Congress (via The Verge).
In the full statement (below), Apple echoed many of the past statements CEO Tim Cook
and other representatives have given throughout the controversy, explaining that the
FBI’s demands for a backdoor into iOS “would set a dangerous precedent for government
intrusion on the privacy and safety of its citizens.”

We have the utmost respect for law enforcement and share
their goal of creating a safer world. We have a team of
dedicated professionals that are on call 24 hours a day,
seven days a week, 365 days a year to assist law
enforcement. When the FBI came to us in the immediate
aftermath of the San Bernardino attacks, we gave all the
information we had related to their investigation. And we
went beyond that by making Apple engineers available to
advise them on a number of additional investigative options.
But we now find ourselves at the center of an extraordinary
circumstance. The FBI has asked a Court to order us to give
them something we don’t have. To create an operating system
that does not exist — because it would be too dangerous.
They are asking for a backdoor into the iPhone —
specifically to build a software tool that can
eak the
encryption system which protects personal information on
every iPhone.
As we have told them — and as we have told the American
public — building that software tool would not affect just
one iPhone. It would weaken the security for all of them. In
fact, just last week Director Comey agreed that the FBI
would likely use this precedent in other cases involving
other phones. District Attorney Vance has also said he would
absolutely plan to use this on over 175 phones. We can all
agree this is not about access to just one iPhone.
The FBI is asking Apple to weaken the security of ou
products. Hackers and cyber criminals could use this to
wreak havoc on our privacy and personal safety. It would set
a dangerous precedent for government intrusion on the
privacy and safety of its citizens.
