Due process in American Criminal justice system
Due process can be considered as fundamental concept in the American order and legal framework.  It was written first in the Fifth Amendment in the constitution of the country, evolved as a consequence of bitter experiences of the people during the times of the kings. At the end of the civil war it is made applicable specifically to the states.  Subsequent inclusions and the amendments like Amendment fourteen as well as the article six emphasized more on the constitutionally awarded rights of life, property and liberty of the individuals and the role of due process to protect them from the powers of the state in depriving the same. At minimum as per the due process, the person whose life, property or the liberty going to get affected need to be served with the notice of the government plans and they need to be provided with a chance to comment on the government actions.  Due process also includes the elements of fairness and equity as part of the procedures followed.  The ultimate objective of the American Criminal justice system is to control crime rate by following all the strategies of crime control with fairness and equity (Cole et al., 78).
