Basic Scenario for all questions: A major industrial site has decided to significantly upgrade an existing process water treatment plant (Note: There are no human waste or public health wastewater issues with this treatment plant). The client's budget is $349,400 + GST. The upgrade project has the following objectives: 1 Improve the quality of the treated water discharged to the nearby stream by the replacement of worn out pumps and other mechanical equipment to change hydraulic flow through the plant by the alteration of some of the pipework and the installation of computer control to replace the current manual process; and 2 To provide an new telemetry system to allow off site monitoring, of the plant operations, by the Client / Principal . The Principal has engaged a firm of Professional Engineers to prepare contract documents for the project with the following contract description: This contract covers a mixture of mechanical, electrical and civil remedial works plus upgraded monitoring installation at the existing water treatment plant at Clutha (CTP). This plant is owned by XYZ Ltd and is currently operated by a Contractor, ABC Ltd. Examples of the relative types of works are: A Remedial Works Clean and paint pipework, remove and recondition dosing pumps and / or discharge nozzles, bird-proof plant rooms, electrical testing of both motors and variable drive units,; and B Improved Install turbidity meters; supply and install new streaming Monitoring current meters., data stations with radios The purpose of the water treatment plant is to treat contaminated process water to a Resource Consent Standard, suitable for discharge to adjacent stream. The estimated duration for the work is 7 weeks total. This contract is a Measure and Value contract. This contract is provided to selected tenderers (3) only. At the end of the tender period three tenders have been received. The tenders were: 1. LMN Ltd was $ 362, 176 +GST and included 8 tags , 2. PPK Ltd was $ 365,000. + GST and included 20 tags ; and 3. ZXK Ltd was $ 355,458 +GST and included 3 tags , one of which required the Client ( XYZ Ltd) to take 100% RESPONSIBILITY FOR COMMISSIONING You are the project manager/ Engineer to Contract and you are responsible for either dealing with the following issues (if you have the authority) OR advising the Principal / Client what action should be taken. QUESTION ONE ADMINISTRATION OF CONTRACTS XXXXXXXXXXGiven that the tender exceeds the Principal's budget you contact the ELECTRICAL Consultant to investigate whether or not there are cheaper plant items that can achieve the project objectives. Should any tenderer be involved in this process as they may have some good ideas to reduce the gap between tender and budget? Give at least two reasons for your choice. In late May 2004 your engineer's representative tells you that he has had to warn the LMN Ltd about leaving the earthworks site in a mess over the last two weekends and that the earthworks subcontractor appears to be ignoring Environmental Management Plan and Quality Plan that all parties had agreed to at the pre-contract meeting seven (7) weeks ago. That weekend it rains heavily and the exposed site floods and turns to mud. The subcontractor is unable to work for a week until the mud dries out. Two days after this weekend LMN Ltd asks for one week Extension of Time (“EOT”) and indicates that it may want a variation to get rid of the dried mud. The Principal agrees to the $10,000, but given that the first electronic control panel installation only took one (1) week, the Principal believes LMN Ltd should only get an EOT of one (1) week or two (2) weeks maximum. Can you make LMN Ltd do the variation for a one (1) or two (2) week EOT? Q1.1- Contractor must be involved with the consultant to generate ideas for reducing
the gap between tender amount and budget amount. Following are the 2 main reasons-
1. Vendors can verify and validate the propose ideas of using alternative cheaper
component for its manufacturability as well as its availability with timeline of
procurement. They can also check technical constraints present in their technical
setup as well as sub contractor technical setup for development of alternative
component. They can also provide a view of cost increase due to propose
change versus cost decrease due to use of alternative cheaper component.
2. Vendors must be having experience to work on similar kind of projects and can
provide many valuable ideas for value engineering. After visualizing the actual
plant and requirement of component with respect to plant, they can revisit to the
specifications given to them and may propose some changes in the specification
within all the quality and safety envelope and would able to identify the areas of
cost saving.
However in this exercise, involved vendors should not get a clue about the
udget of project.

We have evaluated the tenders of below three companies-
1. LMN Ltd.
2. PPK Ltd.
3. ZXK Ltd.
Our recommendation is to accept the tender of LMN Ltd. Below are the main reasons
ehind my recommendation-–
1. The tender of ZXK Ltd is having a Tag which explained that the complete
esponsibility of commissioning is lying with you, which certainly is not an
acceptable clause for you as we have to create sufficient infrastructure for
commissioning. Also we have to make sure that sufficient process and
procedures are in place to manage it effectively.
2. The price quoted in the tender of LMN Ltd is lesser than the price quoted in the
tender of PPK Ltd.
3. All the 8 Tags in the tender of LMN Ltd are acceptable without any issue however
8 tags out of total 20 tags in the tender of PPK Ltd are required some discussion.
However it is not a major setback in the tender of PPK Ltd.
4. The project duration is also increasing significantly in case of ZXK Ltd, however
their price is lesser than LMN Limited. Considering the very small difference in
the price quotation and higher difference in Project schedule, we will not
ecommend the ZXK Ltd.
