The common law has enforced what is known as employee at will concept that states that if an employee doesn’t have a contract guaranteeing a job, he can be fired from work at any time, for any reason or without reason. However, a federal statute under the Occupational Safety and Health Act created certain prohibitions that prohibited employers from firing employees wrongly. This was given the name of tort of wrongful discharge. While tort of wrongful discharge seems to do some level of justice to non-contract employees, it leaves several areas ambiguous and may allow employers to still discharge employees wrongfully.
The tort of wrongful discharge implies that employers cannot fire their employees for a bad reason. Bad reasons consist of four categories. First category is to discharge an employee for refusing to violate a law. The second category is to discharge an employee for excerising a legal...
