The IRAC Approach The IRAC approach is commonly used to answer problem type questions, which appear in both Law assignments and exams. IRAC stands for Issue, Rules, Application and Conclusion. It is a convenient method which corresponds to the proof-making model that is usually used by lawyers in practice. In these type of assignments/exams it is expected that you: Issue: identify the legal issue and the facts relevant to this issue Rule: identify and describe the relevant legal principle/ Application: apply the rule to the facts and argue whether it applies to the facts Conclusion: come to and state your conclusion. Please read, expand and creatively work with the step-by-step guidelines as you see fit. I: Issue • What are the parties disputing about? • What do the parties want and how can they get it? What does your client want? • A contract law question usually involves these issues (not exhaustive): o Whether there is a contract? o Whether there has been a breach of the terms of that contract? o What will be the remedies? • The issue can be formulated in 1 or 2 sentences. R: Rule (Relevant law) • Outline of all legal principles/ authorities/ rules/ presumptions/ exceptions that will be relevant • Outline format- use bullet points/ numbers • This is going to be your plan • Do not regurgitate legal theories/ rules/ principles- it has to be in an outline format only as you can talk in more detail about the principles in the next part A: Application • Apply the legal principles/ tests which have been mentioned in the relevant law part • Law+facts (relevant case authority) • Law+facts (relevant case authority) o Explain the relevant legal principles, apply them to your facts o Explain the relevant legal principles, apply them to your facts • This is where different arguments from both sides can be presented, argued or rebutted C: Conclusion • Conclude on the balance of probabilities which arguments are more likely to succeed and which are not • How will the issue be solved?
