1. Briefly explain how the following legal and ethical considerations relevant to the nursing profession are applied in nursing practice in your State/Te
itory.

a) Children in the workplace:

Children in the workplace require nurses to ensure their safety in North South Wales (NSW). Likewise, accompanying them with parents and keeping them away with from harmful entities is essential.
    

) International Council of Nurses (ICN) Code of Ethics for Nurses (Nursing and Midwifery Board of Australia):
ICN Code of Ethics for Nurses is a guide based upon needs and social values. This consists of two components including provisions and accompanying interpretive statements. There are nine code of ethics defined that are based on nurse to patient, nurse to self, nurse to others, and much more.

    
c) Code of Conduct for Nurses including professional boundaries (Nursing and Midwifery Board of Australia):
The Nursing and Midwifery Board of Australia (NMBA) suggests that the nurses should be clear in their mind regarding their professional role. Likewise, professional behavior also ensures to meet the needs and interest of their clients or patients.


d) Codes of practice (e.g. workplace health and safety, codes of practice or compliance codes)
There are certain code of practices or principles suggesting the respect for dignity of person, professional accountability and responsibility, quality of practice, confidentiality and trust along with collaboration with the patients and the families.
e) Continuing professional education opportunities and mandatory CPD requirements for nurses:
Continuing Professional Development (CPD) are required for the nurses for the renewal of their licenses and continuation of professional service. Nurses are required to obtain 15 CPD in 3-year renewal period, which means 5 units per year for continuation of their professional service.

f) Direct and indirect discrimination and its implications in nursing practice:
Direct discrimination is when two patients are treated differently and less favorably due to some protected characteristic while indirect discrimination is when two patients are treated equally; however, one might have negative effect of the treatment.     

g) Duty of care of an enrolled nurse:
Enrolled nurses are required to observe, measure and record patient’s vital signs. Reporting of changes in patient’s condition to the RN and doctors.


h) Equal employment opportunity (EEO):
EEO refers to non-involvement in employment practices, which are illegal or prohibited by law; in other words, nurses are prohibited to be indulged in any other illegal employment opportunity.

    
i) Human rights including access to healthcare:
Nurses are required to provide healthcare access and care to every patient and human i
espective of their cast, color, religion, identity or any other discriminative entity.

j) Informed consent:
Informed consent refers to the document or process of informing the patient or client regarding the treatment processes or clinical trials.
    

k) Professional indemnity insurance a
angements for enrolled nurses:
Professional Indemnity insurance covers and pays for any cost associated with incident or if something goes wrong during the day- to-day professional work.

l) Public liability insurance a
angements for enrolled nurses:
Enrolled, registered as well as, nurse practitioners are liable to receive Professional indemnity insurance and are required to provide the evidence of their insurance if asked by NMBA on request.
m) Life and death issues: •     Power of attorney:


· Living wills and advanced directives (advanced care plan): Advance care directives is a legal document which specifies the future actions to be taken when the individual no longer remain in the state of decision-making.
             
· Guardianship (guardian of property and person): Guardian or healthcare power of attorney is an individual nominated by patient in order to perform decision making for them.

n) Mandatory reporting (provide examples from a nursing context):
Mandatory reporting refers to the legislative requirement, where nurses are required to report the suspected cases of child abuse or elder abuse to the government authorities.


o) Nursing and Midwifery Board of Australia nursing practice guidelines, standards and fact sheets:

· Enrolled nurse standards for practice:
There are three major domains to be followed, professional and collaborative practice, and provision of care along with analytical and reflective practice.

· Professional practice guidelines (by NMBA):
NMBA guidelines suggest that nurses and midwives should maintain quality in care delivery, focus on nursing and midwifery culture, governance, policy regulation and much more.

· Decision-making framework (DMF) including the nursing flowchart (Reference: National framework for the development of decision-making tools for nursing and midwifery practice):
DMF is an evidence based contemporary document, which is to be used along with practices, policies, regulations and legislations.

    


· Re-entry to practice: This is a board-approved program, accredited by ANMAC and prepares midwifes and nurses for re-entry to nursing.


· Registration guidelines (NMBA guidelines for registration standards):
Registration defines the requirements for the applicants to register as a nurse of midwives. There are various registration standards such as, criminal history, English language skills, and continuing professional development.

p) Privacy and confidentiality:
Privacy is the right of an individual in order to keep their health information private while confidentiality is the duty of nurses or healthcare professionals to keep their client’s information private.

q) Disclosure of health information:
This act allows the healthcare professionals to disclose the medical information under cases where person might be unable to consent or refuses to consent in order to disclose health information.

) Policy frameworks for nursing practice (NMBA policies):
Nurses are required to influence the policy standards in order to assure the quality of care for their patients and these would shape the care, which would be provided today and tomo
ow.


s) Social media policy (Include in your response the potential implications this has on ethics, professionalism and nursing in the health care environment):
Nurses must not share or post anything such as images or information regarding patient, unless there might be patient care related need to disclose the information such as- appeal for organ or blood donors.
