Introduced in the 115th Congress, this federal bill by Ms. Tammy Baldwin, a Junior Senator for Wisconsin was placed on November 15, 2017 in the Congress. With the support of Senators like ‘Shelley Moore Capito (R-WV), Je
y Moran (R-KS), Joe Manchin (D-WV), Richard Blumenthal (D-CT) and Jon Tester (D-MT)’, Ms. Baldwin sponsored this ‘bipartisan VA reform legislation’ known to be to as the ‘Andrew White Veterans Community Care Opioid Safety Act’. This bill was meant to strengthen opioid therapy safety and pain care through the Department of Veterans Affairs (VA) community care programs, including through the VA Choice program.
Background
This bill is believed to be an extension of the Jason Simcakoski Memorial and Promise Act 2016 or Jason’s Law. This bill introduced in 2016 jointly by Ms. Baldwin and Ms. Shelly Moore Capito dealt with the strengthening of Veteran Affairs’ opioid prescribing guidelines and providing a safer yet effective pain management services for the veterans of the war. Lack of sufficient training about opioid on the part of the service providers found to be the real reason behind the initiation of this bill. The case of Jason Simcakoski, a Marine veteran who died of an overdose at the Tomah VA in 2014 is noteworthy in this context. According to the widow of Jason, the lack of knowledge of the service provider transformed her husband to narcotic prone patient. This all happened as the service provider did not have proper training in handling of opioid prescriptive patients. Thus, the 2016 Act paved way for putting in place a stronger and accountable law that increased opioid safety and reduce overprescribing within Veteran Affairs’ heath care system...
