Second, a judge should be of age to qualify for senior status under the Rule of 80. Rule of 80 specifies that a judge may assume senior status at the age of 65 if they have federal judicial experience of at least 15 years. The senior status allows older judges to reach voluntary semi-retirement, which is typically considered advantageous by preventing elderly and infirm judges from continuing service.

A third factor is the candidate’s previous experience in the courts. For example, over 46 percent of the newly named U.S. until their appointment, judges of the district court served as state judges or federal magistrates. The majority of the rest were attorneys with successful careers in litigation, many of whom had prior judicial experience.
