You should divide your paper into the following sections:
Facts(20 points): Provide abriefsummary of therelevantfacts. Describe what happened that gave rise to the original trial court case. How did the trial court rule? Since this is a Supreme Court case, how did the appellate court rule?
Legal Issue Presented(20 points):Briefly state the legal issue (i.e., the question of law) that is being presented to the Supreme Court. (Note that while multiple issues can be presented on appeal, inJacobson, only one issue is before the Court.)
Ruling(40 points): Summarize the Court’s decision and the legal basis/rationale for that decision. How does the Court answer the question presented? What explanation does the majority give for their decision? (Note that this section conforms with the Disposition and Law sections described in the American Bar Association reference above.)
Significance:(20 points) Jacobsonwas decided in the early 20thcentury and remains the law. How is it relevant to the current pandemic? Be sure to explain your answer in detail.
FORMAT
Your assignment must be typed anddouble-spaced. You should use standard margins andno smaller than 12-point font. You must adhere to page limits (i.e., 2 pages); I will not read any material beyond the specified page limit. (Note: You should not adjust margins or font size in an effort to overcome the page limits.) No references are required.
