The relationship between criminal justice system and race
When discussing about criminal justice system and race it will be incomplete without considering the ways slavery and its abolition played into this relationship. It can be stated that the “Black Codes” criminalized being black effectively in terms of making some behaviour illegal only for blacks. It consisted of absence from work, vacancy, possession of firearms as well as insulting acts or gestures. Throwing light on the above-mentioned discussion it can be stated that there was no doubt these acts no doubt have common at time making these laws open for interpretation along with it easy manipulation that indicates the fact that the black people are easily targeted and also punished them. Furthermore, the racialization of the criminal justice system in terms of America had started.
There were continued efforts for criminalizing the black people from 1900’s. The African American was not only the targets of the Jim Crow laws that started in the early 1900’s but there were other non-white groups who were signed out also.
In the recent times for example, mass incarceration stands as a legacy of the past abuses and continuously limit the opportunities in the most vulnerable communities. In the U.S. the incarceration rate is highest as more than 2.3 million Americans are in prison at present. However, 70% of these prisoners are non-white. On the contrary, as per some of the studies it has been informed that ethnic
acial minorities are sentenced in a more harsh manner when compared with white people even after legally relevant factors like the seriousness of the offence and previous criminal record were taken into consideration (Lang & Spitzer, 2020).
Throwing light on the above-mentioned discussion it can be stated that shifting beliefs in terms of crime and race had serious implications for the black Americans in the first half of the 20th century, the racial disparities in the population of prison doubled in the north side. The boom of incarceration changed the transition to adulthood for a lot of generations of the black men.
