Situation 1
In the given situation all of the documents asked for by the therapist are to be provided by the
substance abuse program. The reason for this is that the therapist has been authorized to access
all of the records. In the given case, the following documents are to be made available to the
therapist:
a. Copy of recent discharge summaries
. Copies of past discharge summaries
c. Medical diagnosis reports
The reason for this is that HIPAA allows authorized access to complete records in the given
situation and so all of the discharge summaries are to be made available to the therapist.
Situation 2
The first step is to identify and authorize the doctor. If the doctor is of the medical facility and
has been working there, then he has a right to know about the patient, especially under the given
circumstances. Moreover in case of an emergency HIPAA allows access to information and
patient's medical records with regard to severe allergies. So in this case the hospital should allow
the doctor limited access to general information about the patient. Private and confidential
information should not be given as it is not required under these circumstances.
