Assessment Description
Mediators can improve their skills by reflecting on past mediations and analysing how they
were done. This report requires you to reflect on ONE of the three Mediation sessions done
in Blackboard Collaborate and describe how it was effectively/ineffectively mediated. For this
eport, you will be required to:
 Identify and describe what was causing this conflict and how this conflict was
manifested
 Explain how the mediation approach/model used was effective and why another
conflict management approach might have been more effective
 Describe three mediation techniques that were used effectively in this session
 Recommend three other mediation techniques that could have been used to resolve
this dispute and explain why would be effective
 Describe
iefly how this conflict has helped you understand your own past
experiences with conflict and how you can use this new knowledge to make you into
a better mediator.
When writing your report, be sure to include an introduction which provides a background,
thesis and outline. You will also need a conclusion which summarises the key points,
limitations of your argument and provide future recommendations.
When preparing your report please be sure to make specific references to
mediation/conflict theories and techniques and include in-text references. A reference list
for those references needs to be included at the end of your report. Please see the
Academic Guide for more information on in-text referencing and using reference lists.

What we want to see:
The work must be fully referenced with in-text citations and a reference list at the end. We
ecommend you work with your Academic Writing Guide to ensure that you reference co
ectly.
You will find a link to this document on the main page of every unit, under the 'Assessments'
section. Co
ect academic writing and referencing are essential tasks that you need to learn. We
ecommend a minimum of ten references.
Referencing: References are assessed for their quality. You should draw on quality academic
sources, such as books, chapters from edited books, journals etc. Your textbook can be used as a
eference, but not the Study Guide and lecture notes. We want to see evidence that you are
capable of conducting your own research. Also, in order to help markers determine students’
understanding of the work they cite, all in-text references (not just direct quotes) must include the
specific page numbe
s if shown in the original.
Researching: You can search for peer-reviewed journal articles, which you can find in the online
journal databases and which can be accessed from the li
ary homepage. Reputable news
sites such as The Conversation (https:
theconversation.com/au/health), online dictionaries and
online encyclopedias are acceptable as a starting point to gain knowledge about a topic.
Government departments, research institutes such as the National Health and Medical Research
Council (NHMRC), international organisations such as the World Health Organisation (WHO) and
local not for profit organisations such as the Cancer Council are also good resources.
Formatting: The assessment MUST be submitted electronically in Microsoft Word format.
Other formats may not be readable by markers. Please be aware that any assessments submitted
in other formats will be considered LATE and will lose marks until it is presented in Word.
What we don’t want to see:
Plagiarism: All sources of information need to properly be acknowledged. Please refer to the
plagiarism website on blackboardi. By clicking the 'Upload this file' button you acknowledge that
you have read, understood and can confirm that the work you are about to submit complies with
the Flexible and Online plagiarism policy as shown in the JNI Student Handbook. Like other forms
of cheating plagiarism is treated seriously. Plagiarising students will be refe
ed to the Program
Manager.
Word Count: Marks will be deducted for failure to adhere to the word count – as a general rule
you may go over or under by 10% than the stated length.
Late Submissions: Students are advised that any submissions past the due date incur a 10%
penalty per day, calculated from the total mark e.g. a task marked out of 30 will incur 3 marks
penalty per day.
No submission: Students must attempt all tasks to be eligible to pass the unit.

Introduction
Conflicts are a daily part of life however in professional world conflict or interpersonal conflicts can affect the reputation and life of organisation. Conflict resolution can have variable approaches and mediation is one of them. Conflict between two parties can be solved if they decide to reach an agreement and therefore, mediator helps both of them to reach there. This report focuses upon the provided conflict and the resolution provided by mediator through online mode. Further efforts will be in order to suggest some other mediation techniques that could have been used by mediator and it may have proven more effective in this case.
Cause and manifestation of conflict
Considering the circumstances as well as the information provided in the scenario conflict was between two parties Lisa and Daisy. Where Lisa was an owner of car dealership and Daisy was her customer who purchased a second hand car from her for $1500. Lisa provided Daisy with a standard wa
anty of 90 days however, after 90 days were over, Daisy’s car
oke down and she demanded either a full refund or free repair of the car.
Lisa presented her side with the facts that first of all car
oke down after the wa
anty period was over so it was not her responsibility to repair or pay refund for that. Secondly, Lisa already informed Daisy after the purchase of car to check for the oil and according to her car
oke down because Daisy did not check for oil.
Daisy in return presented that the she had the car checked from an engineer and they informed her that car
oke down due to lack off oil. However, the oil was not filled in appropriate quantity while she bought the car. Due to this, she blamed Lisa that she did not provide enough oil during the selling of car because she herself did not drive the car to the extent that may finish the oil in 3 months. Further, as a result of inspection, Daisy was informed that the overall charges for the repair would be $1200 and she demanded the same from Lisa or a full refund.
Daisy also mentioned that she tried to complain regarding this issue to Lisa via phone as well as email. However, Lisa did not reply and therefore she visited her at Lisa’s dealership where they had heated argument and could not reach to an agreement. Further, both the parties did reach to an agreement where Lisa offered a compensation of $700 and an extended wa
anty for next 3 months however, Daisy demanded if Lisa could repair her car at Lisa’s own garage since that would save cost. The resolution ended here and it would be essential to consider that this could be considered as conclusion. However, it was not full-fledged solution.
Effectiveness of used mediation approach and other suggested approaches
The mediation approach used in order to solve the presented conflict was successful because both the parties did come to conclusion. However, it would be essential to consider that the mediator, Sam, in the presented scenario did not place any decisions or conclusions of her own that is she did not force or ask any of the party to follow her conclusions rather she facilitated the conversation. Therefore, it can be considered that Sam used a facilitative approach in order to solve the conflict between Lisa and Daisy. Further, it would be essential to consider that Sam knew regarding the conflicts between both the parties and therefore she did not initiated the conversation right on. Instead, Sam retrieved the information or heard both the sides privately and then allowed both the parties to confront each other.
Ultimately, Sam allowed Lisa and Daisy to reach a conclusion or solution by themselves. However, at the end the conclusion was not 100% accepted because Lisa offered to provide $700...
