The United States is a country of freedom, liberty, and equal justice. The framers of the 
Constitution gave much emphasize on the system of justice as they had grim experiences about 
the injustices done by the British Government to them. These framers of the Constitution had 
enough experiences through which they realized how inhumanly the British Government accused 
people of crimes which were actually not committed by the accused. And through unfair trials 
the British Government sentenced innumerable people to prevent popular uprisings. With such 
experiences the framers of the Constitution and later on the Bill of Rights strived to guarantee 
some major legal protections for individuals convicted of committing any sort of crime in the 
United States. Hence, the criminal justice system of the United States is a complex but 
exemplary one which has not only emphasized on proper process of judgment but has also 
provided some important rights which can differentiate among a true criminal and an accused 
who has been convicted improperly or mistakenly. There are myriads of such rights provided by 
the Constitution but this discussion is going to emphasize on four of the major rights which 
include the writ of habeas corpus, trial by jury, self-incrimination, and the right to stand against 
excessive, cruel or unusual fines or punishments.  
Though the Constitution has emphasized significantly on the rights of the accused, there 
are controversies regarding such emphasis. Myriads of the populace of the United States are of 
the opinion that such rights should be abolished as they are paving the way for the increase in 
crime rates in the nation. But the Constitution of the United States has always tried to promote a 
balance in the criminal justice system and hence, the entire process of criminal justice is based 
on the assumption that mistakes can be there while detecting actual criminals as law enforcers, 
investigators, and legal practitioners all are humans and error is a part of human decisions.
