The juvenile justice system differs from one state to another. In the Virginia juvenile justice process, a juvenile enters a justice system when a crime is committed and reported by an agency, citizen or parent. In case a juvenile enters the justice system through a police contact, then a decision is made on whether to discharge or counsel the youth back to the society or detain him or her. However, if a citizen or a parent makes a complaint, then the complaint is taken to the intake stage. In that phase, an intake officer decides whether to take an informal action such as detention outreach or shelter care or a formal action such as filing a petition. In case a petition is filed, an intake officer makes a decision on whether to release or detain the juvenile.
Upon detention of the juvenile, a detention hearing is held that focuses on determining whether further detention is needed as well as examine on the merits of the charges brought against the juvenile.
