In this particular case the applicant is L Mudge of the health Ombudsman and the respondent is C Massy, instructed by hall Payne lawyers.
The health Ombudsman has refe
ed to the Tribunal disciplinary proceedings on the 9th of August 2016 against the practitioner Mr. Ba
er. The allegations against the practitioner were a
ows from different notifications to the health Ombudsman are being mentioned below.
A written self-notification made by Mr. Ba
er on 12th in January 2015 and another notification was on the behalf of Mr. Ba
er’s employer on the 5th of Fe
uary 2015.
The allegations that are set out against Mr. ba
er are the trafficking of cannabis and the processing of cannabis. This misconduct violates national law. It has been reported that Mr. ba
er was engaged in the unprofessional conduct into the meaning of s5 of the health practitioner regulation law. He was failed to provide proper written notice to the Nursing Midwifery Board of Australia. According to the ss130 (1) and 133(3) (a) (i) of the national law Mr. ba
er was charged 12 months imprisonment and also changed by other punishable offenses. On the 13th of June 2014, he was sentenced for imprisonment for two years and four months but after that, he was released on parole. From the scenario, it can be noticed that Mr. ba
er was engaged in various unprofessional activities and use to provide false information about the renewal of registration of his application to the board. It has also been decided that the registration of Mr. ba
er will be suspended due to these criminal activities. The criminal offenses with that Mr. ba
er were charged are dangerous drug trafficking and possessing cannabis in multiple times. In the case of Mr. ba
er the violation of professional ethics, as well as unlawful conduct, can be observed. This is been considered as s sensitive issue. Mr. ba
