Part One:
Rosemary is a 72-year-old, Jamaican lady who has lived in the United Kingdom since early childhood. She ma
ied in the UK and raised her family here. Her husband passed away prematurely in an industrial accident. She has since been fiercely independent, retiring at 60 from her insurance work and then travelling the world with friends. She ceased travelling at 70 to help her daughter Winsome with childcare.
Four months ago, after a persistently bad cough that wouldn’t go away, Rosemary visited her doctor. After many tests, it was discovered that she had lung cancer, which had spread to her bones. She was put into the care of the palliative team, where you first met Rosemary.
Due to the rapid decline in her health, Rosemary has had to move in with Winsome and her family.
Rosemary disclosed to you that she doesn’t want to be alive anymore, and she is going to ask Winsome for assistance in dying. She feels that she is a burden to her daughter who is now struggling for childcare as well as looking after her. She also disclosed that Winsome would be better off if she wasn’t around because there is ‘a big insurance payout coming her way’ in the event of her death.

After speaking at length with Rosemary and discussing support options that can be put into place, she explained that she was frightened, anxious and in pain, and wasn’t thinking rationally. She particularly benefitted from speaking to her pastor as a Christian. It transpires she was also wo

She felt the insurance pay out would help the situation. Her pastor reassured her that support was available for Pearl from the Home Office. 1. The Professional Standards of Practice and Behavior for Nurses, Midwives and Nursing Associates- These standards imply the nursing professionals to maintain confidentiality of the patient’s data. They need to respect the people’s right to confidentiality and privacy during the delivery of care and even after their death (Nursing & Midwifery Council, 2015). It involves ensuring that the patients are informed about the care they are receiving and the information about them is shared carefully. The nursing professionals should share the necessary patient’s information with other care professionals only when the interests related to public protection and safety of patient disallow the need to confidentiality. The Nursing professionals should share relevant information with the patients, and their family only as the law permits. The professional standards direct the nursing professionals to uphold their position as a carer. They should promote professionalism and trust while communicating with the media when needed and should protect the dignity and confidentiality of the people receiving care.
2. The General Data Protection Regulation (GDPR) Safeguards the interests of the patients by directing General principles for the transfer of personal data to third party (Intersoft Consulting, 2019). There are international agreements for appropriate level of data protection. The specific laws are listed in the articles 44-50. There are rights to data subjects listed in articles 12-23. Article 5 of GDPR has provisions for integrity and confidentiality of data. It states that the Personal Data of the patients should be processed in a way to maintain data security, protecting it from unlawful and unauthorized processing and securing it from the destruction, accidental loss, using organisational and technical measures. The confidential information about the patient’s state of health, the therapeutic and diagnostic procedures, ongoing surgical/medical treatments as well as the data about personal identity should be kept private and efficiently protected.
Effectiveness of methods of Giving, Receiving and Storing Information
The patients’ personal information is collected to provide effective treatment and care. The information is stored along with the details of care provided as it facilitates continuity of care. The personal data is processed under the Article 6 of GDPR, which includes the personal information related to identity of patient; and sensitive data is processed under Article 9 of Special Categories which includes data about the race, religion, ethnicity, sexual orientation, biometrics and trade union membership.
The records collected and stored are used by the Nursing care professionals to provide safe and effective care, refe
als and facilitate working in partnership with the care providers. The Nursing professionals and physicians need to have your information to take care of your health. A record of care and treatment received by you in the hospital is maintained to address your requirements in case of readmission.
The information is stored in form of electronic data files in database of the hospital and it is a legal duty of the patients to maintain the confidentiality of the information. The patient information is shared with the other organizations only when they are involved in partnership with care providers. Each of the NHS Organisations complies with the NHS Care Records Guarantee which specifies the rules governing the utilization of patient information (Epsom and St Helier University Hospitals, 2019). The patient information is not disclosed with the third parties without their consent except in special cases.
The hospitals are required to legally pass on the necessary information to the specific authorities like during notifications of new births, during an epidemic of infectious disease which may endanger the public safety, or when a formal court order is issued, or during the incident of serious crime.
Lawful basis of Data Processing (known as Trust Processing) has been described in the GDPR Article 6 as lawfulness of Processing, and Article 9 as Processing of Special categories of personal data.
