Key National Policy and Legislation Informing Governance of Mental Health in Australia
The policies and legislation for mental health are one of the essential aspects of governance, as it addresses the different vulnerabilities of individuals suffering from mental disorders. It has been observed that mental disorder affected individuals can be impacted by the way they think as well as behave (WHO, 2018). At times, these individuals also lose the decision-making ability. In many a case, these mentally challenged individuals face discrimination, marginalization and stigma. Mental health policies and legislations provide opportunities for raising public mental health awareness. Further, it also helps in educating the policymakers in terms of human rights, discrimination and stigma.
The Australian Health department in the National Conference in the year 1991 released certain rights and responsibilities in terms of the National mental health conditions (Department of Health, 2017). These policies were based on the UN principles that were based on the legislative strategies outlined by the Australian National Mental health policy. In the next five years, there were certain substantial changes that were implemental in the legislations and policies of the mental health plan (WHO, 2018). This was done with the introduction of Mental Health Bill. The Mental Health Act in the year 1983 consisted of the basic administration, treatment and detention of the mental health patients. This was added with other acts that included ACT Insane and Person Act 1962 and the NSW Lunacy Act 1898. Under the Mental Health Act, there were certain principles and basic rights were added in spite of suffering from mental dysfunction.
It included that these individuals if they can perform functions independently then they will not be restricted from freedom and their dignity and self-respect will not be derogated.
