Information technology (IT) has a major impact on our life, it’s used in every sector; education, communication, transportation, trade and even in healthcare. When IT is used in healthcare, consumers are in a position to receive better and less costly health treatment. IT ensures the availability and accessibility of electronic medical records. Information technology was not only going to improve the hardware and software used bin medical institutions but the decisions made by the physicians and the consumers. (Brailer, 2005)
In our society as technology changes so does healthcare, medicine keeps changing from time to time the healing methods that were use 10 years back are not the same ones being used now. As these healthcare changes occur so does the legislative and regulatory rules that govern them.
In August, 1996, a bill was passed by Congress known as the Kennedy-Kassenbaum bill, it then became Public Law 104-191, and was refe
ed to as the Health Information Portability and Accountability Act of 1996 (HIPAA). (Brailer,2005)
This bill was called for protections of medical information privacy and was made to make the standards of portability and continuity of health insurance coverage better through simplification by the Congress, the Department of Health and Human Services. The main purpose of this bill was to ensure that medical or healthcare employees kept their health insurance coverage even when they changed jobs.
As the years went by the bill kept adding new sections for example, the Administrative Simplification Section, this contained regulations that were intended to standardize electronic transmission of information on health care, reduce associated costs and administrative burdens. By standardizing electronic transmission the healthcare information was guaranteed to be secure and confidential. For this to happen then certain measures were to be put in place in health institutions to ensure that the data was secure and remained private. This was bill was to be effected in the institutions before the end of October 16, 2002, though any organization that was not able to do so was allowed to apply for an extension of one year.
Another example of a section that was added to the bill was concerning privacy it was known as HIPAA Privacy Rule. This was the final privacy rule that was established and published in December 20, 2000. After the rule was established the affected parties (healthcare providers, plans and clearing houses) were not to comply with it unless they did so voluntarily until the 14th of April 2003.
This Privacy Rule was put in place to create a minimum standard to which all states would abide to. All states were to conform to a set of safeguards that were set up to protect the confidentiality of medical information and to ensure that all healthcare...
