Background of the case
Background and Facts
James Francis LeGrow had sexual relations in his bedroom at different times with
three different women. On each occasion, LeGrow secretly videotaped his sexual relations
with them. One day, one of the women found a videotape on her side door that contained an
unlabeled videotape which showed each of the women having sex with LeGrow. She called
one of the other women, who obtained the tape and
ought it to the police. When LeGrow
was contacted by the police, he stated that he thought his girlfriend stole the videotape. The
three women who were taped sued LeGrow in a civil action to obtain damages for invasion of
privacy. The jury found LeGrow liable for the tort of invasion of privacy and awarded two of
the women $100,000 and the third women $155,000. LeGrow appealed.
Issue
Did defendant LeGrow commit the tort of invasion of privacy?
Court’s Reasoning
The court of appeals held that LeGrow’s bedroom was a private place and that the
women would have had a reasonable expectation of privacy while having consensual sexual
elations with the defendant there. The court found that none of the women had expressly or
impliedly consented to the videotaping of their activities. The court of appeals upheld the trial
court’s finding of invasion of privacy and the award of damages to each of the women.
Decision and Remedy
The court of appeals held that the defendant had committed the tort of invasion of
privacy. The court of appeals affirmed the judgment of the trial court.
Things led to the ethical issue - Right to publicity
Considering this case, we can say that the company had faced different ethical issues
which led to this lawsuit. Each person has the exclusive legal right to control and profit from

the commercial use of his or her name and personality during his or her lifetime. This is a
valuable right, particularly to well-known persons such as sports figures and movie stars. Any
attempt by another person to appropriate a living person’s name or identity for commercial
