Bob Wheelie has always loved pushbikes and out of his passion, he bought a store dealing in pushbikes from Mr Spoke. However, certain misrepresentations regarding the aspect were made by Mr Spoke when he sold off his shop to Bob. Inflated the profit figures and being ignorant in this matter, Bob could not figure out the deal. He soon discovered the issue and realized that he has been fraudulently forced into the deal. As such, he wishes to sue Mr Spoke for his fraudulent behavior.
Issue
The issues that arise in the matter are as follows:
•    Whether Bob has a right to sue Mr Spoke for any misrepresentation?
•    Whether Bob can take the plea that he has been forced into this contract by means of fraud?
•    Whether there is any ground to escape liability on part of Mr Spoke?
•    Whether there is any room for the concept of caveat emptor to be applied here?
